This article discusses judicial recruitment in civil law countries. It introduces the emergence of comparative global studies. The United States was the first country to offer university courses on the judiciary outside of law schools. Significant empirical research has been carried out on the system of judicial recruitment since the latter half of the twentieth century and in recent years much of the work of empirically oriented judicial researchers has focused on reforming traditional ways of recruiting and appointing judges. Nicholas Griffin has brought his customary expertise to the project, (...) and in snaring fourteen other contributors to this volume, has produced a welcome addition to an academic's library of Russell materials.The shape of the volume, its contents and its presentation, however, unfortunately reflect the lopsided nature of current Russell studies. One hopes for a companion volume that has the breadth of the earlier volume edited fifty years ago by Paul Schilpp, but in vain. This book is overwhelmingly about Russell before 1918, almost entirely about philosophy of mathematics, epistemology and logic, and several of the pieces easily could have been included in a festschrift for Frege instead.What is included is well done, but to call it "the most convenient and accessible guide to Russell available" is to speak in comparative terms. To be fair, it sets out to focus on a narrow definition of Russell's contributions to modern philosophy, and the contributors accomplish this task. Ian Grattan-Guinness writes on "Mathematics in and behind Russell's Logicism, and its Reception," a subject that continues into "Bertrand Russell's Logicism" by Martin Godwyn and Andrew D. Irvine. The roots of analytic philosophy are of primary concern in this volume, so Richard L. Cartwright explores "Russell and Moore, 1898-1905" and Michael Beaney relates "Russell and Frege." "The Theory of Descriptions" by Peter Hylton sets up two pieces on "Russell's Substitutional Theory" (Gregory Landini) and "The Theory of Types" (Alasdair Urquhart), while Paul Hager's "Russell's Method of Analysis" leads into "Russell's Neutral Monism" (R.E.Tully) and "The Metaphysics of Logical Atomism" (Bernard Linsky).The next portion of the book expands the intellectual focus somewhat, with "Russell's Structuralism and the Absolute Description of the World" by William Demopoulos—perhaps [End Page 349] the best in a series of good papers—and "From Knowledge by Acquaintance to Knowledge by Causation" by Thomas Baldwin. Approaching the end of the book, Anthony Grayling's essay on "Russell, Experience, and the Roots of Science" remains firmly planted in the pre-1918 milieu, though his tentative commentary on Human Knowledge at least glimmers the extension of Russell's intellectual life into the post-Great War period.Effectively the entire second half of Russell's life is left to the final contributor, Charles Pidgen, for commentary. Author of Russell on Ethics, much of Pigden's short essay here ("Bertrand Russell: Moral Philosopher or Unphilosophical Moralist?") somewhat plaintively directs the reader to his book for an elaboration of why Russell is worth reading after 1918, at least on the subject of ethics. Of the other authors, only Hager (317) observes the extent to which Russell's post-War work mistakenly has been ignored.The book concludes with a selective bibliography. The audience, for the most part, is a specialist one, with only some essays accessible to the general reader. On that score, Griffin's introduction and his own essay, "Russell's Philosophical Background," are easily the most readable. At the risk of quibbling, I was disturbed by the uneven production of the book, as each author set his own standard for footnotes, endnotes and bibliography (creating a jumble of styles). Even within individual contributions, there are a number of inconsistencies in notation as well as typographical errors.By the end, I was left hoping there might be a second companion volume for Bertrand Russell, one that reflects what he spent the last fifty years of his life thinking, writing, and doing. In the absence of such material (which is of far greater popular interest today just as it was in Russell's lifetime), this book by itself is more of a companion to current Russell studies than to Bertrand Russell himself.Peter H. D History, Philosophy and Religious Studies / U. of Winnipeg Winnipeg, , Canada   .@. hether or not it is wise to defend one’s first book against the slings and Warrows of outrageous fortune, Bertrand Russell was never one to let indignities pass without response, and I will take my (...) example from him. Peter Stone’s review of my The ABC of Armageddon: Bertrand Russell on Science, Religion and the Next War, – is so irretrievably muddled that when he concludes “a thoroughly confused book ends on a thoroughly confused note”, this state of confusion most accurately represents the condition of the reviewer. The problem here is not an author and his book “adrift at Armageddon”, as the title of Stone’s review maintains, but a reviewer rowing furiously with one oar. Whatever inadequacies there are in The ABC of Armageddon, they are not those Stone so enthusiastically catalogues in his series of speculations as to what I might have done, but didn’t. In awaiting this review in Russell, I worried about how my various suggestions about Russell’s writing in the interwar period—even my definition of what the interwar period was—would be received. To list a few: the idea that the Great War constituted a dividing line in his work, and why; that his work in the interwar period should be judged as a whole; that his work in the interwar period was worth evaluating, not simply being dismissed as evidence of early philosophical dotage; the way Russell’s published ideas were entwined with those of his Anglo-American contemporaries; the theme of the “old savage in the new civilization” in Russell’s work, and in that of his contemporaries; the dimension of “rhetorical performance” and Russell’s deliberate stance as a  Russell, n.s.  (): – (at ). russell: the Journal of Bertrand Russell Studies n.s.  (summer ): – The Bertrand Russell Research Centre, McMaster U.  -  Discussion preacher; the differences between The Prospects of Industrial Civilization and The Scientific Outlook, on the one hand, and Religion and Science and Power: a New Social Analysis, on the other; the possible influence of Albert Schweitzer on the value of “an operational metaphysic” that allowed an older Russell to act as though ideas like “reverence for life” were true, even if they could not be proven. The list could continue. Stone overlooks all of these ideas, preferring instead to demonstrate my inability to hit targets at which he feels I should have aimed, characterizing my approach and my intentions in some unhelpful ways that are well wide of the mark. I was astounded to learn, for example, that I “assume the role of a political theorist towards Russell’s work”, and thus I “attempt to lay out an argument by Russell and critique it, so as to leave behind a stronger argument in its wake” (p. ). Because I am a political theorist, Stone concludes, “this book is simply a failure as a work of history” (p. ). Instead, being an historian he says, would have involved “situating Russell’s views in the personal and social context in which they emerged.” Writing as a “political theorist” himself (out of the Political Science department at Rochester University, where he is adjunct faculty), Stone’s defence of the historical approach is no doubt well intentioned. Had he followed his own prescription, however, he would have found this book to be substantially the same text as my dissertation (“The Old Savage and the Scientific Outlook: Science, Religion and Social Ethics in the Writings of Bertrand Russell, – ” [McMaster, ]). BackgroundThere is a growing interest in using cognitive–behavioural therapy (CBT) with people who have Asperger syndrome and comorbid mental health problems.AimsTo examine whether modified group CBT for clinically significant anxiety in an Asperger syndrome population is feasible and likely to be efficacious.MethodUsing a randomised assessor-blind trial, 52 individuals with Asperger syndrome were randomised into a treatment arm or a waiting-list control arm. After 24 weeks, those in the waiting-list control arm received treatment, while those initially randomised to treatment were followed (...) up for 24 weeks.ResultsThe conversion rate for this trial was high (1.6:1), while attrition was 13%. After 24 weeks, there was no significant difference between those randomised to the treatment arm compared with those randomised to the waiting-list control arm on the primary outcome measure, the Hamilton Rating Scale for Anxiety.ConclusionsTrials of psychological therapies with this population are feasible. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories (...) and On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

The debate surrounding eliminative materialism, and the role of empiricism more broadly, has been one of the more prominent philosophical debates of the last half-century. But too often what is at stake in this debate has been left implicit. This essay surveys the rhetoric of two participants in this debate, Paul Churchland and Thomas Nagel, on the question of whether or not scientific explanations will do away with the need for nonscientific descriptions. Both philosophers talk about this possibility in language (...) reminiscent of revolutionary politics. These authors do not see eliminative materialism merely as an idea to be evaluated, but a revolution to be welcomed or quashed. After surveying their rhetoric, the paper turns to the work of four philosophers—G.E.M. Anscombe, Peter Winch, Paul Holmer, and G.H. von Wright—to suggest that there is within Wittgensteinian tradition a ‘nonrevolutionary’ approach to the question of eliminative materialism. (shrink)

It was a novel, among other things, which originated the atomic bomb. H. G. Wells dedicated The World Set Free, published in 1913, to Frederick Soddy, a pioneer in the exploration of radioactivity. Using Soddy’s research as a base, Wells predicted the advent of artificial radioactivity in 1933, the year in which it actually took place; and he foresaw its use for what he named the “atomic bomb.” In Wells’ novel these bombs are used in a world war that erupts (...) in mid-century and is so catastrophic that a world government is formed, initiating a new age powered by the peaceful use of the atom. The physicist Leo Szilard, a long-time admirer of Wells, read this novel in 1932, the year before he first intuited the possibility of a nuclear chain reaction. The novel seems to have become part of his own mental chain reaction. One that took place at an almost unconscious level during the spring that Szilard spent at the Strand Palace Hotel in London, by his own admission doing nothing. He would only monopolize the bath from around nine to twelve in the morning, since “there is no place as good to think as a bathtub.”1 The theories that resulted from this prolonged immersion were introduced by references to Wells; and Szilard, having realized the atomic bomb, spent the rest of his life trying to realize the world government which, in the Wells novel, was its consequence.Literature, which was part of the genesis of nuclear weaponry, continues to be an inextricable aspect of its nature. For Derrida, in fact, we are facinga phenomenon whose essential feature is that of being fabulously textual, through and through. Nuclear weaponry depends, more than any weaponry in the past, it seems, upon structures of information and communication, structures of language, including non-vocalizable language, structures of codes and graphic decoding. But the phenomenon if fabulously textual also to the extent that, at the moment, a nuclear war has not taken place: one can only talk and write about it.2The linguistic nature of the arms race, of peace talks and negotiations, has been thoroughly analyzed. Likewise there is a growing number of books on the nature of nuclear war. But there is also a growing body of novels, poems, and plays making up a literature of nuclear holocaust. As the example of Wells’ novel shows, this is not altogether unprecedented; nuclear literature predates Hiroshima. But the subject of nuclear war has, up till now, mainly served the purposes of science fiction; only rarely—as in the cases of A Canticle for Leibowitz and On the Beach—have science fiction authors risen above the lowest common denominator of that genre. In the 1980s, every year sees the publication of works which demand serious attention both as literature and as fictive strategies for comprehending a subject that is commonly called “unthinkable.” Russell Hoban’s Riddley Walker, Bernard Malamud’s God’s Grace, Maggie Gee’s The Burning Book, Tim O’Brien’s Nuclear Age—these works explicitly preoccupied with nuclear holocaust may be supplemented by other works of the eighties with a persistent apocalyptic undertone, works such as Doris Lessing’s Canopus in Argos series, Umberto Eco’s Name of the Rose, and Mario Vargas Llosa’s War of the End of the World. And these are only the literary manifestations of a widespread movement in all the arts aimed at expressing the dominant condition of our time.3 1. Of course, this critique can easily be dismissed as asking for a book that Krieger did not wish to write. His method has produced important results, for Krieger has discerned developmental trends overlooked by others. Otherwise, the only area that I think needs further discussion is Ranke's conception of the nature and function of science. Krieger seems to imply that science automatically means (...) a nomological approach modeled upon the mechanical physical sciences. But Ranke was nourished in an atmosphere where science was often equated with Naturphilosophie. Certainly, Ranke's language is filled with images and terms popularized by Naturphilosophen. Ranke's quest for a science of history may fit very nicely with the ideal dimension of his thought if the science that he is talking about is analogous to Naturphilosophie. It may turn out that the basic polarity in Ranke's idea of history is an analytic construct that has little meaning for Ranke's own intentions. Krieger ends his study with a chapter devoted to the meaning of Ranke's work for modem historiography. It is the dialectical synthesis of the whole study. After recapitulating Ranke's achievements, Krieger then emphasizes the breach that separates Ranke from our conceptual world. We no longer share Ranke's beliefs or values. In fact, for most of us "he must seem simply archaic, and the more he is himself historically restored the more archaic he must seem" (p. 355). For the reader who had to struggle through this difficult book and to contend with Professor Krieger's passion for complex dependent clauses, this announcement appears as a grand denouement. But the shock is only temporary. Krieger's assertion of the differences that separate Ranke from us serves as a warning to those who still take Ranke's approach as an objective model for historical reconstruction. The deeper meaning of Ranke's view of history is the affirmation of history as an autonomous and independent form of knowledge. "History is an inimitable way of rendering comprehensible modes of humanity which must otherwise be incomprehensible" (p. 356). This form of knowledge, which is devoted "to the actual but equipped with a language of common sense organized around the categorical," proceedes by arranging things along a time line (p. 357). Here Krieger launches a spirited counterattack against those modem theorists who have questioned the viability of history as an independent form of knowledge or who have minimized the importance of developmental analysis, preferring instead to concentrate upon relatively static deep structures. Krieger's study affirms Ranke's project in its most general sense; that history is a cumulative logic of the actual, "the meeting ground of philosophy, science, and cataclysmic experience" (p. 356). And it serves, at the same time, as a positive demonstration that a developmental analysis does impart knowledge that other approaches cannot achieve. In this sense, Krieger's masterful study of Ranke reaffirms Ranke's central position as a founding father of modem historical thought. This is a remarkable book. Almost all of it is a study, very well researched and presented, of four major English philosophical movements: Newtonians, the Utilitarians, the Oxford Hegelians, and the Russell, G. E. Moore, and Whitehead group. The study shows the initial enthusiasm, optimism, and confidence of each of the groups. Each believed that it had found a way to solve the intellectual and perhaps moral and social problems of mankind. As each movement developed, the confidence slowly eroded when philosophical problems and difficulties failed to disappear. The picture Quinn presents of these movements is very interesting. He has grouped together 128 HISTORY OF PHILOSOPHY much detail that makes us see the original intentions of the leaders of each of these movements. He also deftly shows how as stumbling blocks arose each movement lowered its goals and began to fade. Employing a very wide range of printed sources, Quinn presents a series of convincing vignettes, and in so doing be often reveals features of these movements that have been... (shrink)

No point of John C.Calhoun's political thought has been more disputed than exactly where it is situated in the theoretical landscape. Calhoun has been treated as the �Marx of the master class� by Richard Hofstadter; a �reactionary conservative� arguing eclectically from liberal premises by Louis Hartz; an authentic conservative by Russell Kirk, Clinton Rossiter and August Spain; and a precursor to the pluralist vision of politics by Peter Drucker. Two of the most engaging treatments of Calhoun's thought are (...) Darryl Baskin's and Peter Steinberger's, both of relatively recent vintage. Baskin argues that despite Calhoun's use of vocabulary borrowed from organic conservatism he is essentially a classical liberal and, as such, is engaged in the typically liberal �flight from community�. He has no true notion of civic virtue and his concept of the public interest is only a mechanistic sum of private interests. Steinberger agrees that Calhoun is a liberal, but argues that his contribution to American liberalism is precisely to sublate selfishness to an authentic civic virtue. These disputes are interesting, but I suggest that in the efforts to contain Calhoun within the conservative/liberal scheme of categorization some of the subtlety of his thought is lost. Too often an appreciation of his thought is sacrificed to an underlying agenda of attacking or defending one ideology or another. In the present critique I attempt to recover some insights that have been submerged in other treatments. Calhoun's constitutional theory of concurrent majoritarianism, rather than his liberal or conservative bent, is the focal point of sections III and IV. I argue that Calhoun's theory exposes -- sometimes unwittingly -- the stern limits of what constitutions can accomplish. In section V I suggest that insofar as Calhoun is generally a liberal (as Hartz, Baskin and Steinberger contend) an internal contradiction within his theory points to a paradox at the very heart of liberalism. We determine exactly how hard it is to enumerate the Kolmogorov function, which (...) assigns to each string x its Kolmogorov complexity: • For every underlying universal machine U, there is a constant a such that C is k(n)-enumerable only if k(n) ≥ n/a for almost all n. • For any given constant k, the Kolmogorov function is k-enumerable relative to an oracle A if and only if A is at least as hard as the halting problem. • There exists an r.e., Turing-incomplete set A such for every non-decreasing and unbounded recursive function k, the Kolmogorov function is k(n)-enumerable relative to A. The last result is obtained by using a relativizable construction for a nonrecursive set A relative to which the prefix-free Kolmogorov complexity differs only by a constant from the unrelativized prefix-free Kolmogorov complexity. Although every 2-enumerator for C is Turing hard for K, we show that reductions must depend on the specific choice of the 2-enumerator and there is no bound on the quantity of their queries. We show our negative results even for strong 2-enumerators as an oracle where the querying machine for any x gets directly an explicit list of all hypotheses of the enumerator for this input. Philosophical interest in the biological concept of function stems largely from concerns about its teleological associations. Assigning something a function seems akin to assigning it a purpose, and discussion of the purpose of items has long been off-limits to science. Analytic philosophers have attempted to defend ‘function’ by showing that claims about functions do not involve any reference to a problematic notion of purpose. To do this, philosophers offer short lists of necessary and sufficient conditions for the application of the (...) concept—where the conditions involve only acceptable physical or biological notions—and claim that the set of conditions captures the import of function statements. Little is known about how children and adolescents conceptualize psychiatric disorders and psychiatric treatment. In the current study, children and adolescents diagnosed with Attention Deficit Hyperactivity Disorder (ADHD) were interviewed about their understanding of ADHD and the medication used to treat their disorder. The participants were all taking Ritalin and ranged in age from 5 to 16 years. With increasing age, children improved in their ability to name their condition and the medication. Latency-aged children often did not perceive Ritalin as (...) helpful while adolescents recognized some value in taking medication. Some of the adolescents were also able to describe medication side effects. The implications of these findings for patient education are discussed. (shrink)

'Modern History' views claim that in order for a trait X to have the proper function F, X must have been recently favored by natural selection for doing F (Griffiths 1992, 1993; Godfrey-Smith 1994). For many traits with prototypical proper functions, however, such recent selection may not have occurred, since traits may have been maintained owing to lack of variation or selection for other effects. I explore this flaw in Modern History accounts and offer an alternative etiological theory, which I (...) call the 'Continuing Usefulness' account. According to my view, a trait has the proper function F if and only if, first, the trait was favored by selection for doing F at some point (perhaps far in the past), and, secondly, the trait has recently contributed to survival and reproduction by doing F. This separates the requirement involving natural selection from the one involving the recent past, two issues that the Modern History account conflates. The clear separation allows a detailed analysis of the causal judgments and form of adaptationism that ground the etiological approach to function. (shrink)

Our inability to feel what others feel makes it difficult to understand how they think. Because moral intuitions organize political attitudes, moral empathy gaps can exacerbate political conflict (and other kinds of conflict as well) by contributing to the perception that people who do not share our moral opinions are unintelligent and/or have malevolent intentions.

This paper uses diversity management as a placeholder for human rights policy. By diversity management, I mean those policy techniques that a society can use to deal with diversity, which include not only decisions to make diversity a subject of active legal and governmental intervention, but also decisions to leave diversity to informal, unregulated choices by individuals or civil society institutions. My discussion proceeds with particular reference to the United States, in part because it has been relatively successful in managing (...) its diversity in recent decades—relative, that is, both to its own past and to the record of other countries today. An approach to diversity management “works,” in my view, if and to the extent that the country’s vulnerable minorities enjoy some social mobility, are integrated into the major institutions of society, have access to political influence roughly proportional to their limited numbers, are free to live according to their own group values and practices, and do not feel deep alienation from the dominant cultural norms. By this definition, the American system works relatively well—with the qualifications and exceptions noted just above. The paper proceeds in three parts. Part I seeks to sharpen our understanding of diversity by analyzing several different ways of understanding and defining that idea, with a view to underscoring the significance of choosing one or another measure of it. Part II discusses two examples— multiracial individuals and anti-profiling laws—to illustrate the inevitable politicization of certain demographic categories when used for politicallysensitive purposes. Part III presents some distinctive and, in some cases, unique features of the American approach to diversity management. Most of these features, I argue, effectively advance the cause of minority mobility and integration, whereas some tend to undermine these goals. (shrink)
